Guided bike rides and related guiding services

1. Our contract with you

1.1 These Terms and Conditions apply to bookings made with Emma Handley trading as Pedal Teesdale ("we", "us", "our") for guided cycle rides, route-led cycling activities and related guiding services.

1.4 These Terms explain what you are booking, what is included, what happens if plans change, and the responsibilities we each have. Please read them carefully before making a booking request.

1.5 Each participant must read and accept these Terms before taking part. For group bookings, the person making the booking is responsible for ensuring that every participant receives these Terms, completes the required rider information, and confirms their acceptance before the Ride.

1.6 Each rider must complete a Rider Information Form and accept these Terms either by signed copy or online acceptance. If the rider information form is not received by the deadline we specify, we may refuse participation. Where the failure is within the participant’s or group organiser’s control, no refund will be due except where required by law.

2. What you are booking

2.1 You are booking a place on a guided cycling activity, guided ride tour or route-led cycling experience (the "Ride") delivered on the date, time and at the location stated on the ride listing and in your booking confirmation.

2.2 The Ride may be road, gravel, mixed-terrain, mountain bike or off-road, as described on the relevant ride listing. The ride description, route summary, distance, expected terrain, required kit and any stated suitability information form part of the contract.

2.3 Unless expressly stated in writing, the price includes guiding only. It does not include travel, accommodation, food or drink, bike hire, personal equipment, repair parts, taxi fares, rescue transport or other third-party costs.

2.4 We are responsible for providing the guided ride tour or route-led cycling activity using reasonable care and skill, including general route leadership and safety management. Each participant remains responsible for their own cycling conduct, choices, bike, equipment, road positioning and compliance with applicable laws and access rules.

2.5 Guides have full authority over safety decisions during the Ride. This includes route changes, delays, pauses, shortening the route, ending the Ride early, refusing participation, or removing a participant where reasonably necessary for safety, welfare, legal, access or operational reasons.

3. Booking information and rider declarations

3.1 When making or confirming a booking, we will ask you to complete a Rider Information Form. This must be completed before the Ride, as set out in clause 1.6.

3.2 You confirm that all information you provide is accurate, complete and not misleading. You must tell us promptly if any information changes before the Ride.

3.3 Where a participant provides inaccurate or incomplete information, or fails to provide information reasonably required for safety or administration, we may refuse participation or cancel that participant’s booking. Where this is due to something within the participant’s control, no refund will be due except where required by law.

4. Who can book and take part

4.1 Rides are for adults aged 18 or over unless the ride listing expressly states otherwise.

4.2 By making a booking request or taking part, you confirm that you are at least 18 years old and legally capable of entering into a contract.

4.3 We may request proof of age before confirming a booking or before allowing a participant to start the Ride.

4.4 We may refuse or cancel any booking before confirmation, including where a Ride appears unsuitable for the participant, information has not been provided, payment has not been received, or there is an obvious error in availability, pricing or booking information.

5. When the contract is formed

5.1 Bookings are made online using our booking provider, Bókun, or by another method we expressly confirm in writing.

5.2 Your request for a booking is an offer to enter into a contract with us. A contract is not formed until:

·     payment in full, or any required deposit, has been successfully processed and received by us or our payment provider;

·     we have accepted your booking; and

·     we have sent you a booking confirmation email or other written confirmation.

5.3 It is your responsibility to check that all booking details are correct, including the date, time, meeting point, Ride selected, participant details and contact information.

5.4 If payment is not received when due, we may cancel your booking request and no contract will have been formed.

6. Prices, payments and obvious errors

6.1 Prices are those shown on the ride listing displayed on our website and at checkout at the time you make your booking request.

6.2 Payment in full is required at the time of booking unless the ride listing expressly offers a deposit, staged payment or other written arrangement.

6.3 Card payments are handled by Stripe or another payment provider shown at checkout. We do not store your full card details.

6.4 An obvious error includes, for example, a price displayed as £0.00 or materially lower than the intended price, duplicate availability for the same place, a technical error in Bókun, or availability shown for a date or Ride that is not actually available.

6.5 If there is an obvious error in pricing, availability or booking information, we may cancel the booking and refund any amount paid for that Ride.

7. No 14-day cooling-off period for date-specific rides

7.1 Because our rides are leisure services scheduled for a specific date or period, the usual 14-day cancellation or cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once your booking is confirmed.

7.2 This does not affect the cancellation, refund or transfer rights set out in these Terms, including clauses 14 and 15, or any rights you have where we are at fault or the law gives you a remedy.

8. Cycling ability, safety and participant responsibilities

8.1 Cycling is an outdoor activity that carries inherent risks. These include, but are not limited to, falls, collisions with other participants, vehicles, animals or objects, uneven or changing terrain, road hazards, weather conditions, limited phone signal, mechanical problems, and the actions of third parties.

8.2 By booking and participating, you acknowledge that you understand these inherent risks and choose to participate voluntarily.

8.3 You must choose a Ride suitable for your cycling ability, fitness, confidence, health, bike and equipment. If you are unsure whether a Ride is suitable, you should contact us before booking.

8.4 By booking and participating in a Ride, you confirm that you can ride a bicycle competently and safely in the conditions relevant to the activity booked, including on public roads, shared routes, trails and/or varied terrain where applicable.

8.5 You are responsible for ensuring that you are physically fit and medically able to take part. If you have any medical condition, injury or health concern that may affect your ability to participate safely, you should seek appropriate medical advice before booking and inform us in advance where relevant.

8.6 You must arrive on time with a safe, roadworthy and suitable bike for the terrain, together with the equipment listed on the ride page, booking form or pre-ride information.

8.7 Before attending, you should carry out a basic pre-ride safety check, such as an M Check or ABCD check, and have any issues checked by a competent mechanic before the Ride.

8.8 Unless expressly agreed otherwise in writing, helmets must be worn at all times during guided rides. Your helmet must be correctly fitted, in good condition, less than 5years old, comply with a recognised safety standard (EN 1078) and be suitable for the riding and terrain involved.

8.9 You must bring any medication, food, fluids, clothing, lights, tools, spares and weather protection reasonably required for the Ride.

8.10 You must follow all guide instructions and safety guidance, comply with the Highway Code and applicable access rules, ride safely and responsibly, act with consideration towards other participants and members of the public, and use equipment and bicycles in a safe and appropriate condition.

8.11 You must not attend under the influence of alcohol or drugs, or in any condition that makes it unsafe for you to ride.

8.12 You are responsible for your own personal belongings during the Ride. We accept no responsibility for loss, theft or damage to personal items except where caused by our negligence.

9. Cycling ability declaration

9.1 You will be asked to select the description that best reflects your current cycling ability. This helps you decide whether the Ride is appropriate for your experience level and helps us plan the Ride safely.

9.2 Beginner: you have basic cycling ability and can ride a bicycle confidently in low-traffic or off-road environments such as parks, cycle paths or quiet roads. You may not have recent experience riding in traffic.

9.3 Intermediate: you are a confident and regular cyclist. You can ride safely on roads with traffic, follow road signs and signals, and maintain a steady pace over moderate distances and varying terrain.

9.4 Advanced: you are an experienced cyclist, comfortable riding in traffic, on longer routes and on varied or challenging terrain. You can maintain higher speeds and ride confidently in group settings.

9.5 By selecting a level, you confirm that it accurately reflects your current cycling ability and fitness. You understand that selecting an incorrect level may affect your safety and the suitability of the Ride for you.

10. Refusal of participation or removal from a Ride

10.1 We may refuse to allow you to start, require you to leave a Ride, or terminate a booking without refund where, in our reasonable opinion:

·     you do not possess the necessary cycling ability, fitness or confidence;

·     the Ride is not suitable for your apparent fitness, experience, health, bike or equipment;

·     your bike or kit is unsafe or unsuitable;

·     you are under the influence of alcohol or drugs;

·     you are unwell or injured in a way that makes participation unsafe;

·     you behave abusively, dangerously, unlawfully or irresponsibly;

·     you do not follow guide instructions, road traffic law, access rules or safety guidance;

·     continuing your participation would create an unacceptable risk to you, the group, the guide or others; or

·     weather, safety, welfare, access or operational considerations require us to do so.

10.2 If this happens because of something within your control, no refund will be due except where the law requires otherwise.

11. Health, medical information and emergencies

11.1 You are responsible for deciding whether you are medically fit to take part.

11.2 Before the Ride, you must tell us about any medical condition, allergy, injury, medication, disability, access need or other issue that could reasonably affect your safe participation or the way we should respond in an emergency.

11.3 We only ask for and use health information that is reasonably necessary for safety, inclusion and emergency planning.

11.4 In an emergency, we may share relevant information with emergency services, medical professionals, your emergency contact, our insurer, our late-back or emergency support contact, or other persons reasonably involved in managing the situation.

12. Mechanical problems, incidents and getting home

12.1 You remain responsible for your bike’s condition, repair decisions and repair costs.

12.2 You must bring the tools, spares and repair items specified in the ride listing or pre-ride information. Unless stated otherwise, this will usually include at least a spare inner tube suitable for your bike and any essential medication or personal items.

12.3 We may, at our discretion, offer minor roadside assistance such as help with punctures, chain issues, simple adjustments or temporary fixes. Any such help is provided as a courtesy only.

12.4 We do not guarantee that any repair will be possible, successful or permanent, and we do not accept responsibility for future bike functionality or financial loss arising from a courtesy repair except where caused by our negligence.

12.5 If you ask us to assist with a minor repair, we will require your verbal consent before doing so. You remain responsible for deciding whether to accept that assistance.

12.6 If a bike cannot be repaired safely, the plan may involve walking to a road or access point and arranging a taxi, lift or other transport. Unless we expressly agree otherwise, any transport contract and cost is between you and the transport provider.

12.7 Any local taxi suggestions or transport provider details we provide are for convenience only. We do not guarantee availability, coverage, timing, safety, suitability or price, and we are not responsible for the acts or omissions of any transport provider.

13. Minimum numbers for scheduled group rides

13.1 Scheduled group rides require a minimum of 4 confirmed participants to run, unless the ride listing states otherwise.

13.2 We may choose to run with fewer participants, but you accept and agree that we are not obliged to do so.

13.3 Unless a different deadline is stated on the ride listing, the go/no-go point for minimum numbers is 48 hours before the scheduled start time. For example, if a Ride is scheduled to start at 2.00pm on Sunday, the go/no-go point is 2.00pm on the preceding Friday.

13.4 If fewer than the minimum number are confirmed at the go/no-go point, we may contact confirmed participants by email, text message or Bókun message and offer one or more of the following options:

·     run the Ride by upgrading it to a private or bespoke ride if participants agree to pay the minimum total fee for that ride type;

·     transfer to another scheduled date of the same or a comparable Ride, subject to availability; or

·     receive a full refund of the amount paid for that Ride.

13.5 Any top-up required to reach a stated minimum total fee will be split equally between confirmed participants unless the group agrees a different arrangement and confirms it to us in writing.

13.6 If we offer options and do not receive a response within 12 hours, we may treat the booking as cancelled by us and issue a refund.

13.7 Refunds will usually be made to the original payment method. We may ask for further information to verify the payer and prevent fraud. Refund timing may depend on Stripe, Bókun, banks and card providers, but we will aim to process any refund due within 14 days of confirming that it is payable.

14. If you cancel

14.1 Because ride places are limited and rides are time-specific leisure services, the following cancellation terms apply unless the ride listing states different terms.

14.2 Cancellation requests can be made via the Bókun cancellation process or by email to hello@pedalteesdale.co.uk. The effective time of cancellation is when we receive the cancellation request.

14.3 Scheduled group rides:

·     14 days or more before the Ride: you may choose a full refund or one free transfer to another available date of the same Ride type.

·     7 to 13 days before the Ride: you may choose one free transfer or a 50% refund.

·     0 to 6 days before the Ride: no refund is due, although we may offer a transfer or credit if we are able to fill your place or if we choose to do so.

14.4 Private or bespoke rides:

·     14 days or more before the Ride: you may reschedule or receive a refund less any non-recoverable costs already committed specifically for your booking.

·     7 to 13 days before the Ride: you may reschedule or receive a 50% refund.

·     0 to 6 days before the Ride: no refund is due unless we rebook the date or agree otherwise.

14.5 Non-recoverable costs may include route-specific preparation, bespoke planning time already undertaken, booking platform charges, payment processing charges, pre-paid venue costs, permits, third-party guide or support costs, or other costs specifically committed for your booking and not reasonably recoverable by us.

14.6 Any deduction we make will be reasonable and reflect costs or losses we cannot avoid or recover.

14.7 You may request to transfer your place to another adult participant up to 48 hours before the scheduled start time. Any transfer is subject to our approval, the replacement rider meeting the Ride requirements, completing the required rider information, and accepting these Terms by the deadline we specify.

15. If we cancel or materially change the Ride

15.1 We reserve the right to cancel or amend a Ride due to reasons including, but not limited to:

·     unsafe or unsuitable weather conditions;

·     flooding, ice, snow, high winds, lightning, extreme heat, poor visibility or fire risk;

·     route closures, access restrictions, land management restrictions, roadworks or events;

·     insufficient bookings or minimum numbers not being met;

·     guide illness, injury, bereavement or other operational issues;

·     mechanical issues affecting the group;

·     safety, welfare or emergency concerns;

·     public authority advice or legal restrictions; or

·     other events outside our reasonable control.

15.2 We will communicate cancellation or material changes using the contact details provided in your booking, usually by email, text message, phone, Bókun message or a combination of these. You are responsible for checking messages before travelling to the Ride.

15.3 Where possible, we will give you as much notice as reasonably practicable. Some safety decisions may need to be made shortly before or during the Ride.

15.4 If we cancel a Ride before it starts, or make a material change before the start time so that the Ride can no longer reasonably be described as what you booked, you may choose either:

·     a transfer to another available date of the same or a comparable Ride; or

·     a full refund of the amount you paid to us for that Ride.

15.5 We are not responsible for refunding or reimbursing travel, accommodation, bike hire, childcare, loss of earnings or any other third-party or consequential costs, unless the law requires otherwise or the loss was caused by our negligence.

15.6 No compensation is payable for route changes, delays, shortening, pauses, itinerary changes or cancellation decisions made in good faith for safety, welfare, access, legal or operational reasons, except where required by law.

16. Late arrival, withdrawal on the day and no-shows

16.1 You must arrive at the meeting point by the time stated in the booking confirmation or pre-ride information.

16.2 If you arrive more than 10 minutes after the scheduled start time, miss the start, leave the Ride early by choice, or do not attend, we may be unable to wait or to make arrangements for you to join the group safely.

16.3 In those circumstances, no refund will be issued.

17. Third-party risks, public infrastructure and other road or trail users

17.1 We are not responsible for the actions or omissions of third parties, including other road users, other trail users, animals, landowners, public authorities, transport providers or members of the public, except where caused by our negligence.

17.2 We are not responsible for defects in public roads, bridleways, byways, tracks, trails, signage, gates, bridges or other public or third-party infrastructure, except where caused by our negligence.

18. Our liability

18.1 We will provide the guided ride tour or route-led cycling activity using reasonable care and skill.

18.2 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under the laws of England and Wales, including the Consumer Rights Act 2015.

18.3 Subject to clause 18.2, we are not liable for losses that are not a foreseeable result of our breach of contract or negligence, or for business losses suffered by a consumer booking a leisure ride.

18.4 Cycling carries inherent risks, including falls, collisions, changing surfaces, weather exposure, third-party actions and mechanical failure. These risks cannot be eliminated entirely even where reasonable care is taken.

19. Insurance

19.1 Pedal Teesdale is operated by Emma Handley as a sole trader. Where a guided ride, route-led cycling activity or related guiding service is delivered by Emma Handley within the scope of her relevant British Cycling-approved leadership qualifications. Pedal Teesdale relies on the insurance arrangements available to qualifying individual British Cycling coaches, leaders and instructors.

19.2 British Cycling insurance arrangements may include public liability and professional indemnity cover for qualifying individual coaches, leaders and instructors, subject to the terms, conditions, exclusions and eligibility requirements of the relevant British Cycling insurance policies. Activities outside the scope of the relevant qualification are not covered.

19.3 Pedal Teesdale does not provide insurance for your bicycle, equipment, travel, cancellation, personal accident, medical costs, theft, loss or damage to personal belongings.

19.4 You are responsible for arranging any personal insurance you want, including cover for your bicycle, equipment, personal accident, medical costs, travel, cancellation, theft, loss or damage to personal belongings.

19.5 Nothing in this clause limits or excludes any liability that cannot lawfully be limited or excluded under the laws of England and Wales.

20. Photos, video and media consent

20.1 We may take photos and/or short video clips during Rides for legitimate business records, safety, incident management, training or promotional purposes.

20.2 We will only use identifiable photos or video of you for marketing, promotional, website, social media, press, funder or partner-reporting purposes where you have given consent, unless another lawful basis clearly applies in the circumstances.

20.3 We will provide a clear opt-in/opt-out choice in the rider information form. You can choose not to appear in identifiable marketing images without affecting your booking.

20.4 If you do not want to appear in marketing images, please tell us before the Ride and remind the guide at the start. We will respect that request so far as reasonably practicable.

20.5 You may withdraw consent for future use of identifiable marketing images by contacting hello@pedalteesdale.co.uk. Withdrawal will not affect lawful use before withdrawal and may not require us to remove materials already printed, distributed, reposted by others, or otherwise outside our reasonable control.

20.6 We may still use non-identifiable images, general landscape or route images, or images where individuals are not the focus and cannot reasonably be identified, where lawful and appropriate.

21. Complaints

21.1 If you are unhappy with any part of our service, please contact us at hello@pedalteesdale.co.uk as soon as reasonably possible, and preferably within 14 days of the Ride, so that we can investigate and try to resolve the issue promptly.

21.2 If your complaint relates to an accident, injury, near miss or safeguarding concern, please contact us as soon as possible and provide all relevant details.

21.3 Asking you to contact us promptly does not remove or reduce any legal rights you may have.

22. Incidents and insurance claims

22.1 If an incident occurs, you must follow reasonable safety instructions from the guide and, where safe and possible, help record relevant information such as time, place, names, contact details, witness details, vehicle registration numbers, photographs of the location or defect, and a brief factual account.

22.2 Where an incident is relevant to British Cycling insurance, legal support or another insurance arrangement, it will be reported promptly using the relevant incident reporting process.

22.3 You must not admit liability, make offers of settlement, discuss fault with other parties, post about the circumstances of an incident on social media, enter into correspondence about liability, or disclose documents where doing so could prejudice an insurance claim, legal support or investigation.

22.4  If you receive correspondence from a third party or their representative about an incident connected with a Ride, please forward it to us unanswered as soon as possible. Where British Cycling insurance or legal support is relevant, correspondence will also be provided to British Cycling or its appointed representatives in accordance with their requirements.

23. Data protection

23.1 We use personal data to administer bookings, communicate with riders, take payments, run rides safely, manage incidents, deal with complaints, keep business records and meet legal, tax and insurance obligations.

23.2 Our Privacy Notice and Cookie Notice below explain how we use personal data and cookies, including where Bókun, Stripe and Termly are involved.

24. Changes to these Terms

24.1 We may update these Terms from time to time. The version in force at the time your booking is confirmed will apply to that booking, unless a change is required by law or is clearly beneficial to you.

25. General

25.1 If any part of these Terms is held to be unenforceable, the rest will remain in force.

25.2 You may not transfer your rights or obligations under these Terms except as expressly allowed in clause 14.7 or with our written agreement.

25.3 No person other than you and us has any right to enforce these Terms unless expressly stated.

26. Governing law and jurisdiction

26.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

26.2 You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
