Big Bike Revival Event Terms and Conditions

1. OUR CONTRACT WITH YOU
1.1 These Terms and Conditions apply to bookings made with Emma Handley trading as Pedal Teesdale ("we", "us", "our") for Big Bike Revival cycling events, guided cycle activities, route-led cycling activities, cycling confidence activities and related event services.

1.4 These Terms explain what you are booking, what is included, what happens if plans change, and the responsibilities we each have. Please read them carefully before making a booking request.
1.5 Each participant must read and accept these Terms before taking part.
1.6 Each participant must complete a Participant / Rider Information Form before a ride and accept these Terms either by signed copy or online acceptance. If the Participant / Rider Information Form is not received by the deadline we specify, we may refuse participation.
1.7 The Event is delivered as part of Cycling UK’s Big Bike Revival programme. By booking this event you agree to their Privacy policy and the sharing of your name and email address.
2. WHAT YOU ARE BOOKING
2.1 You are booking a free place on a Big Bike Revival cycling event, guided cycling activity, led ride, route-led cycling experience, bike check, basic repair session, maintenance learning session, cycling confidence activity or related activity, as described on the relevant event listing and in your booking confirmation.
2.2 The Event may include one or more of the following elements, as stated on the event listing:
· a bike check or minor mechanical support;
· a basic repair or “fix” session;
· a maintenance or “learn to fix” session;
· cycling confidence or bike handling activities for returning or low-confidence riders;
· route planning or group riding guidance;
· a guided ride, led ride or route-led cycling activity using local cycling infrastructure; or
· other practical cycling support connected with the Big Bike Revival programme.
2.3 The ride element of the Event is designed for adults who can already ride a bicycle but may not have cycled recently, may lack confidence, or may want support using local cycling infrastructure, including quiet roads, cycle paths, shared-use routes, crossings, junctions and other local routes.
2.4 The Event may take place on roads, cycle paths, shared routes, recreational spaces, gravel, mixed-terrain, trails or other off-road areas, as described on the relevant event listing. The event description, route summary, distance, expected terrain, required kit and any stated suitability information form part of the contract.
2.5 Unless expressly stated in writing, the Event does not include travel, accommodation, food or drink, bike hire, personal equipment, repair parts, taxi fares, rescue transport, major repairs, replacement components, storage, collection, delivery or other third-party costs.
2.6 We are responsible for providing the parts of the Event delivered by us using reasonable care and skill, including event administration, general coordination, guided ride leadership and safety management where those elements are delivered by us.
2.7 The mechanical support, bike check, repair activity and maintenance learning session are delivered by Swale Cycles. Swale Cycles is responsible for providing those elements using reasonable care and skill. We are not responsible for the acts or omissions of Swale Cycles except where caused by our negligence or where the law makes us responsible.
2.8 Each participant remains responsible for their own cycling conduct, choices, bike, equipment, road positioning and compliance with applicable laws and access rules.
2.9 The event leader, ride leader, instructor, mechanic or session provider has full authority over safety decisions during the Event. This includes route changes, delays, pauses, shortening the route, ending the Event early, refusing participation, or removing a participant where reasonably necessary for safety, welfare, legal, access, insurance, programme or operational reasons.
3. BOOKING INFORMATION AND PARTICIPANT DECLARATIONS
3.1 When making or confirming a booking, we will ask you to complete a Participant / Rider Information Form. This must be completed before the Event, as set out in clause 1.6.
3.2 You confirm that all information you provide is accurate, complete and not misleading. You must tell us promptly if any information changes before the Event.
3.3 Where a participant provides inaccurate or incomplete information, or fails to provide information reasonably required for safety, inclusion, safeguarding, insurance, reporting or administration, we may refuse participation or cancel that participant’s booking.
3.4 Because the Event is free, no refund will be due where participation is refused or a booking is cancelled. This does not affect any rights you have where we are at fault or the law gives you a remedy.
4. WHO CAN BOOK AND TAKE PART
4.1 Events are for adults aged 18 or over unless the event listing expressly states otherwise.
4.2 By making a booking request or taking part, you confirm that you are at least 18 years old and legally capable of entering into a contract.
4.3 The ride element of the Event is suitable for returning or low-confidence adult riders who can already ride a bicycle independently. It is not a learn-to-ride session and is not suitable for complete beginners who cannot yet ride a bicycle.
4.4 We may request proof of age before confirming a booking or before allowing a participant to start the Event.
4.5 We may refuse or cancel any booking before confirmation, including where the Event appears unsuitable for the participant, information has not been provided, required consent has not been given, or there is an obvious error in availability, eligibility or booking information.
5. WHEN THE CONTRACT IS FORMED
5.1 Bookings are made online using our booking provider, through Cycling UK’s Big Bike Revival booking process, or by another method we expressly confirm in writing.
5.2 Your request for a booking is an offer to enter into a contract with us. A contract is not formed until:
· we have accepted your booking; and
· we have sent you a booking confirmation email or other written confirmation.
5.3 It is your responsibility to check that all booking details are correct, including the date, time, meeting point, Event selected, participant details and contact information.
5.4 If required information is not received when due, we may cancel your booking request and no contract will have been formed.
6. FREE EVENT, LIMITED PLACES AND OBVIOUS ERRORS
6.1 The Event is free to attend unless the event listing expressly states otherwise.
6.2 Places are limited. A confirmed booking gives you a place on the Event, subject to these Terms and the suitability, eligibility and safety requirements set out in them.
6.3 An obvious error includes, for example, duplicate availability for the same place, a technical error in the booking system, availability shown for a date or Event that is not actually available, or a booking shown as confirmed when the Event is full.
6.4 If there is an obvious error in availability, eligibility or booking information, we may cancel the booking.
7. FREE DATE-SPECIFIC EVENT
7.1 The Event is free to attend but places are limited and must be booked in advance.
7.2 Your booking is for a specific Event on the date, at the time and at the location stated in the event listing and booking confirmation.
7.3 Because no payment is taken for the Event, no refund will be due if you cancel, do not attend, arrive late, are refused participation in accordance with these Terms, or leave the Event early.
7.4 Please tell us as soon as possible if you can no longer attend so that we may offer your place to another participant.
7.5 Nothing in this clause affects any legal rights you may have where we are at fault or where the law gives you a remedy.
8. CYCLING ABILITY, SAFETY AND PARTICIPANT RESPONSIBILITIES
8.1 Cycling is an outdoor activity that carries inherent risks. These include, but are not limited to, falls, collisions with other participants, vehicles, animals or objects, uneven or changing terrain, road hazards, weather conditions, limited phone signal, mechanical problems, equipment failure, and the actions of third parties.
8.2 By booking and participating, you acknowledge that you understand these inherent risks and choose to participate voluntarily.
8.3 You must choose an Event suitable for your cycling ability, fitness, confidence, health, bike and equipment. If you are unsure whether an Event is suitable, you should contact us before booking.
8.4 By booking and participating in an Event involving riding, you confirm that you can ride a bicycle independently, competently and safely in the conditions relevant to the activity booked.
8.5 You understand that the ride element is intended to build confidence for returning or low-confidence riders on local cycling infrastructure. It is not a learn-to-ride session and does not provide one-to-one beginner cycling instruction.
8.6 You are responsible for ensuring that you are physically fit and medically able to take part. If you have any medical condition, injury or health concern that may affect your ability to participate safely, you should seek appropriate medical advice before booking and inform us in advance where relevant.
8.7 You must arrive on time with a safe, roadworthy and suitable bike for the Event, together with the equipment listed on the event page, booking form or pre-event information.
8.8 Before attending, you should carry out a basic pre-event safety check, such as an M Check or ABCD check, and have any issues checked by a competent mechanic before the Event where possible.
8.9 Unless expressly agreed otherwise in writing, helmets must be worn at all times during guided rides, cycling confidence activities or riding activities. Your helmet must be correctly fitted, in good condition, comply with a recognised safety standard and be suitable for the riding and terrain involved.
8.10 You must bring any medication, food, fluids, clothing, lights, tools, spares and weather protection reasonably required for the Event.
8.11 You must follow all event leader, ride leader, instructor and mechanic instructions and safety guidance, comply with the Highway Code and applicable access rules, ride safely and responsibly, act with consideration towards other participants and members of the public, and use equipment and bicycles in a safe and appropriate condition.
8.12 You must not attend under the influence of alcohol or drugs, or in any condition that makes it unsafe for you to ride, handle a bicycle, use tools, take part in a workshop or participate in the Event.
8.13 You are responsible for your own personal belongings during the Event. We accept no responsibility for loss, theft or damage to personal items except where caused by our negligence.
9. CYCLING ABILITY DECLARATION
9.1 You may be asked to confirm that the description below reflects your current cycling ability. This helps you decide whether the Event is appropriate for your experience level and helps us plan the Event safely.
9.2 Returning or low-confidence rider: you can already ride a bicycle independently, but you may not have cycled recently, may lack confidence, may be unfamiliar with local cycling infrastructure, or may want support before cycling more regularly.
9.3 You may be comfortable riding in low-traffic or off-road environments such as parks, cycle paths, shared-use routes or quiet roads, but may want support with route choice, group riding, junctions, crossings, road positioning or using local cycling infrastructure.
9.4 The Event is not suitable for complete beginners who cannot yet ride a bicycle independently, unless the event listing expressly states otherwise.
9.5 By confirming your ability, you confirm that it accurately reflects your current cycling confidence, ability and fitness. You understand that giving inaccurate information may affect your safety and the suitability of the Event for you.
10. REFUSAL OF PARTICIPATION OR REMOVAL FROM AN EVENT
10.1 We, Swale Cycles, the event leader, ride leader, instructor or mechanic may refuse to allow you to start, require you to leave an Event, or terminate a booking where, in our reasonable opinion:
· you do not possess the necessary cycling ability, fitness or confidence;
· you cannot ride a bicycle independently where the Event involves riding;
· the Event is not suitable for your apparent fitness, experience, health, bike or equipment;
· your bike or kit is unsafe or unsuitable;
· you are under the influence of alcohol or drugs;
· you are unwell or injured in a way that makes participation unsafe;
· you behave abusively, dangerously, unlawfully or irresponsibly;
· you do not follow event leader, ride leader, instructor or mechanic instructions, road traffic law, access rules or safety guidance;
· continuing your participation would create an unacceptable risk to you, the group, the event team, Swale Cycles or others; or
· weather, safety, welfare, access, safeguarding, insurance, programme or operational considerations require us to do so.
10.2 If this happens because of something within your control, you will not be entitled to any compensation or replacement place except where the law requires otherwise.
11. HEALTH, MEDICAL INFORMATION AND EMERGENCIES
11.1 You are responsible for deciding whether you are medically fit to take part.
11.2 Before the Event, you must tell us about any medical condition, allergy, injury, medication, disability, access need or other issue that could reasonably affect your safe participation or the way we should respond in an emergency.
11.3 We only ask for and use health information that is reasonably necessary for safety, inclusion, safeguarding and emergency planning.
11.4 In an emergency, we may share relevant information with emergency services, medical professionals, your emergency contact, Cycling UK, Swale Cycles, our insurer, our late-back or emergency support contact, or other persons reasonably involved in managing the situation.
12. MECHANICAL CHECKS, REPAIRS, LEARN SESSIONS AND GETTING HOME
12.1 You remain responsible for your bike’s condition, repair decisions and repair costs.
12.2 The bike check, minor repair activity and maintenance learning session are delivered by Swale Cycles. Swale Cycles is responsible for carrying out those elements using reasonable care and skill.
12.3 A bike check, minor repair or basic adjustment is not a full service, full safety inspection, valuation, warranty or guarantee that your bicycle is roadworthy, legally compliant or free from defects.
12.4 Any advice, demonstration or supervised activity given during a maintenance learning session is general practical guidance only. You remain responsible for deciding whether you are competent to carry out any repair, adjustment or maintenance task yourself.
12.5 Minor repairs or adjustments may be offered at Swale Cycles’ discretion and may depend on time, parts, workshop capacity, safety, the condition of the bike and the nature of the issue.
12.6 Unless expressly stated otherwise, free Event support does not include replacement parts, major repairs, specialist workshop work, collection, delivery, storage or ongoing maintenance.
12.7 We and Swale Cycles do not guarantee that any repair will be possible, successful or permanent, and do not accept responsibility for future bike functionality or financial loss arising from a repair except where caused by negligence or breach of legal duty.
12.8 If you ask for assistance with a minor repair, Swale Cycles or the relevant mechanic may require your consent before doing so. You remain responsible for deciding whether to accept that assistance.
12.9 If a bike cannot be repaired safely, the plan may involve walking to a road or access point and arranging a taxi, lift or other transport. Unless we expressly agree otherwise, any transport contract and cost is between you and the transport provider.
12.10 Any local taxi suggestions or transport provider details we provide are for convenience only. We do not guarantee availability, coverage, timing, safety, suitability or price, and we are not responsible for the acts or omissions of any transport provider.
13. EVENT CAPACITY
13.1 Places are limited, and the Event may be cancelled, amended or shortened where participant numbers, staffing, volunteer availability, venue capacity, safety, welfare, access, insurance, programme or operational considerations require us to do so.
13.2 If we need to cancel, amend or shorten the Event, we may contact confirmed participants by email, text message or booking system message and offer one or more of the following options:
· transfer to another scheduled date of the same or a comparable Event, subject to availability;
· attend a modified or shorter Event; or
· cancel the Event.
13.3 Because the Event is free, no refund will be payable if the Event is cancelled. This does not affect any rights you have where we are at fault or the law gives you a remedy.
14. IF YOU CANCEL
14.1 Because places are limited and Events are time-specific, you must tell us as soon as possible if you can no longer attend.
14.2 Cancellation requests can be made via the booking cancellation process or by email to hello@pedalteesdale.co.uk. The effective time of cancellation is when we receive the cancellation request.
14.3 You may request to transfer your place to another adult participant up to 48 hours before the scheduled start time. Any transfer is subject to our approval, the replacement participant meeting the Event requirements, completing the required participant or rider information, and accepting these Terms by the deadline we specify.
14.4 If you cancel, do not attend or leave the Event early, you will not be entitled to any compensation or replacement place except where the law requires otherwise.
15. IF WE CANCEL OR MATERIALLY CHANGE THE EVENT
15.1 We reserve the right to cancel or amend an Event due to reasons including, but not limited to:
· unsafe or unsuitable weather conditions;
· flooding, ice, snow, high winds, lightning, extreme heat, poor visibility or fire risk;
· route closures, access restrictions, land management restrictions, roadworks or events;
· insufficient bookings, staffing constraints or volunteer availability;
· event leader, ride leader, instructor, mechanic or provider illness, injury, bereavement or other operational issues;
· mechanical issues affecting the group;
· safety, welfare, safeguarding or emergency concerns;
· public authority advice or legal restrictions;
· Cycling UK programme, insurance or delivery requirements; or
· other events outside our reasonable control.
15.2 We will communicate cancellation or material changes using the contact details provided in your booking, usually by email, text message, phone, booking system message or a combination of these. You are responsible for checking messages before travelling to the Event.
15.3 Where possible, we will give you as much notice as reasonably practicable. Some safety decisions may need to be made shortly before or during the Event.
15.4 If we cancel an Event before it starts, or make a material change before the start time so that the Event can no longer reasonably be described as what you booked, we may offer a transfer to another available date of the same or a comparable Event.
15.5 We are not responsible for refunding or reimbursing travel, accommodation, bike hire, childcare, loss of earnings or any other third-party or consequential costs, unless the law requires otherwise or the loss was caused by our negligence.
15.6 No compensation is payable for route changes, delays, shortening, pauses, itinerary changes or cancellation decisions made in good faith for safety, welfare, access, legal, insurance, programme or operational reasons, except where required by law.
16. LATE ARRIVAL, WITHDRAWAL ON THE DAY AND NO-SHOWS
16.1 You must arrive at the meeting point by the time stated in the booking confirmation or pre-event information.
16.2 If you arrive more than 10 minutes after the scheduled start time, miss the start, leave the Event early by choice, or do not attend, we may be unable to wait or to make arrangements for you to join the group safely.
16.3 In those circumstances, you will not be entitled to any compensation or replacement place.
17. THIRD-PARTY RISKS, PUBLIC INFRASTRUCTURE AND OTHER ROAD OR TRAIL USERS
17.1 We are not responsible for the actions or omissions of third parties, including other road users, other trail users, animals, landowners, public authorities, transport providers, Swale Cycles or members of the public, except where caused by our negligence or where the law makes us responsible.
17.2 We are not responsible for defects in public roads, bridleways, byways, tracks, trails, signage, gates, bridges or other public or third-party infrastructure, except where caused by our negligence.
18. OUR LIABILITY
18.1 We will provide the parts of the Event delivered by us using reasonable care and skill.
18.2 Swale Cycles is responsible for providing the bike check, mechanical support, repair activity and maintenance learning session using reasonable care and skill.
18.3 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under the laws of England and Wales, including the Consumer Rights Act 2015.
18.4 Subject to clause 18.3, we are not liable for losses that are not a foreseeable result of our breach of contract or negligence, or for business losses suffered by a consumer attending a free community cycling event.
18.5 Cycling carries inherent risks, including falls, collisions, changing surfaces, weather exposure, third-party actions and mechanical failure. These risks cannot be eliminated entirely even where reasonable care is taken.
19. INSURANCE
19.1 The Event is intended to be registered and delivered as part of Cycling UK’s Big Bike Revival programme. It is also intended to rely on Cycling UK special events insurance
19.2 Cycling UK special events insurance includes public liability cover for qualifying activity providers, event organisers, ride leaders and volunteers, subject to the terms, conditions, exclusions and eligibility requirements of the relevant policy. Activities outside the scope of the registered Event, Cycling UK programme requirements or the relevant insurance policy may not be covered.
19.3 Where Swale Cycles delivers mechanical support, bike checks, repair activity or maintenance learning sessions, Swale Cycles is responsible for ensuring that it holds appropriate qualifications, competence, risk assessments and insurance for the services it provides.
19.4 We do not provide insurance for your bicycle, equipment, travel, cancellation, personal accident, medical costs, theft, loss or damage to personal belongings.
19.5 You are responsible for arranging any personal insurance you want, including cover for your bicycle, equipment, personal accident, medical costs, travel, cancellation, theft, loss or damage to personal belongings.
19.6 Nothing in this clause limits or excludes any liability that cannot lawfully be limited or excluded under the laws of England and Wales.
20. PHOTOS, VIDEO AND MEDIA CONSENT
20.1 We may take photos and/or short video clips during Events for legitimate business records, safety, incident management, training, Cycling UK programme reporting or promotional purposes.
20.2 We will only use identifiable photos or video of you for marketing, promotional, website, social media, press, funder, Cycling UK or partner-reporting purposes where you have given consent, unless another lawful basis clearly applies in the circumstances.
20.3 We will provide a clear opt-in/opt-out choice in the Participant / Rider Information Form. You can choose not to appear in identifiable marketing images without affecting your booking.
20.4 If you do not want to appear in marketing images, please tell us before the Event and remind the event leader at the start. We will respect that request so far as reasonably practicable.
20.5 You may withdraw consent for future use of identifiable marketing images by contacting hello@pedalteesdale.co.uk. Withdrawal will not affect lawful use before withdrawal and may not require us to remove materials already printed, distributed, reposted by others, submitted to Cycling UK, or otherwise outside our reasonable control.
20.6 We may still use non-identifiable images, general landscape or route images, or images where individuals are not the focus and cannot reasonably be identified, where lawful and appropriate.
21. COMPLAINTS
21.1 If you are unhappy with any part of our service, please contact us at hello@pedalteesdale.co.uk as soon as reasonably possible, and preferably within 14 days of the Event, so that we can investigate and try to resolve the issue promptly.
21.2 If your complaint relates to Swale Cycles’ bike check, repair activity, mechanical support or maintenance learning session, we may refer the matter to Swale Cycles for investigation and response.
21.3 If your complaint relates to an accident, injury, near miss or safeguarding concern, please contact us as soon as possible and provide all relevant details.
21.4 Asking you to contact us promptly does not remove or reduce any legal rights you may have.
22. INCIDENTS AND INSURANCE CLAIMS
22.1 If an incident occurs, you must follow reasonable safety instructions from the event leader, ride leader, instructor, mechanic or emergency services and, where safe and possible, help record relevant information such as time, place, names, contact details, witness details, vehicle registration numbers, photographs of the location or defect, and a brief factual account.
22.2 Where an incident is relevant to Cycling UK special events insurance, organisers’ liability insurance, legal support or another insurance arrangement, it will be reported promptly using the relevant incident reporting process.
22.3 You must not admit liability, make offers of settlement, discuss fault with other parties, post about the circumstances of an incident on social media, enter into correspondence about liability, or disclose documents where doing so could prejudice an insurance claim, legal support or investigation.
22.4 If you receive correspondence from a third party or their representative about an incident connected with an Event, please forward it to us unanswered as soon as possible. Where Cycling UK insurance, Swale Cycles’ insurance or legal support is relevant, correspondence may also be provided to Cycling UK, Swale Cycles, the relevant insurer or their appointed representatives in accordance with their requirements.
23. DATA PROTECTION
23.1 We use personal data to administer bookings, communicate with participants, run Events safely, manage incidents, deal with complaints, keep business records, meet legal, tax and insurance obligations, and comply with Cycling UK Big Bike Revival programme monitoring and reporting requirements. Please see the Privacy Notice shared at the time of booking and in the event description for more information about how personal data is used.
23.2 We may share relevant personal data with Cycling UK, Swale Cycles, insurers, emergency services, medical professionals, booking providers, safeguarding contacts or other persons where reasonably necessary for Event delivery, safety, reporting, insurance, safeguarding, legal compliance or emergency purposes.
23.3 Our Privacy Notice and Cookie Notice explain how we use personal data and cookies, including where booking providers, payment providers, Cycling UK, Swale Cycles or other delivery partners are involved.
24. CHANGES TO THESE TERMS
24.1 We may update these Terms from time to time. The version in force at the time your booking is confirmed will apply to that booking, unless a change is required by law, required by Cycling UK programme or insurance requirements, or is clearly beneficial to you.
25. GENERAL
25.1 If any part of these Terms is held to be unenforceable, the rest will remain in force.
25.2 You may not transfer your rights or obligations under these Terms except as expressly allowed in clause 14.3 or with our written agreement.
25.3 No person other than you and us has any right to enforce these Terms unless expressly stated. This does not prevent Swale Cycles from relying on any clause that refers to its role, responsibility, insurance or liability where it is lawful and appropriate for it to do so.
26. GOVERNING LAW AND JURISDICTION
26.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.
